6.Description of the contractNorthern Region Water Board, through the Government of Malawi, has applied for a loan from the European Investment Bank towards the funding of Malawi NRWB Water Efficiency Project, and intends to apply part of the proceeds towards the procurement of 15,000 number Prepaid Water Meters and accessories.

8.Eligibility and rules of originFirms originating from all countries of the world are eligible to participate in this tender. However, the EIB shall not provide finance, directly or indirectly, to or for the benefit of, award a contract under any EIB Project to, or enter into any relationship with, an individual or entity who is subject to financial sanctions imposed by the European Union pursuant to Chapter 2 of Title V of the Treaty on European Union or article 215 of the Treaty on the Functioning of the European Union, either autonomously or pursuant to the financial sanctions decided by the United Nations Security Council on the basis of article 41 of the UN Charter.

9.Grounds for exclusionTenderers must submit a signed declaration that they are not involved in the following:• Conflict of interest;• Guilty of misrepresenting information required by the Contracting Authority or failing to supply the required information;• Finding themselves in one of the exclusion situations for this procurement.

10.Number of tendersTenderers should submit only one tender.

11.Tender guaranteeBids must be accompanied by bid security in a form of Bank Guarantee of US$80,000 (eighty thousand United States Dollars)

12.Performance guaranteeThe successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract at the signing of the contract.

14.Tender validityTenders must remain valid for a period of 90 days after the deadline for submission of tenders.

15.Delivery period of goods and provision of related services3 years (July 2017 to June 2020) i.e. 5,000 prepaid water meters and the associated accessories per year

16.Selection criteriaThe following selection criteria will apply. In the case of tenders submitted by a consortium, these selection criteria will apply to the consortium as a whole:(a) Preliminary examination of bids: Bids will be examined to confirm that all the requested documents and information have been provided, and to determine the completeness of each document submitted. It will be confirmed that the following documents and information have been provided in the bid: bid submission form (the form should be signed and evidence of authority to sign the bid should be included); price schedules, bid security, signed audited financial statements, manufacturer’s authorization letters, brochures from manufacturers, Manufacturer’s Quality Management International Standards Certification (ISO or equivalent) and signed form of covenant of integrity. Bidder eligibility, and that the bidder has no history of non-performance will also be assessed.(b) Technical Specifications Adherence and Proposed Plan: All bids that pass step (a) above shall be thoroughly screened to assess adherence of the offered goods to the technical specifications and proposed delivery schedule.(c) Post-qualification requirements: For the bids that pass steps (a) and (b) above, the Purchaser shall assess the capacity of the Bidder. The requirements not included in the text below shall not be used in the assessment:(i) Financial CapabilityThe Bidder shall furnish documentary evidence that it meets the following financial requirement(s):• Liquid assets and/or credit facilities from recognized financial institutions of at least US$0.75 million.• Average Annual Turnover (related to prepaid water meters and accessories) of at least US$3 million for each of the last three years.(ii) Experience and Technical CapacityThe Bidder shall furnish documentary evidence to demonstrate that it meets the following experience requirement(s):• Successful completion of at least three (3) similar contracts of at least US$1.5 million in value and of similar complexity involving similar goods in the last five (5) years. Evidence may be in form of statement from purchaser/customer and a copy of signed delivery note.(iii) The Bidder shall furnish documentary evidence to demonstrate that:• The manufacturer has received internationally approved certification for Quality Management Standards for the goods offered in the bid.• The Bidder has or is making arrangements to have an office or agent in the SADC region to provide after-sales services• The Bidder should make a provision so that spare parts will be available locally to facilitate quick maintenance, repair and spare parts stocking.• The Bidder must provide Technical Backup for five (5) years.• Prepaid Water Meters must carry a patent and latent defect warranty of 12 months. Computer hardware and peripherals supplied by the Bidder must carry a standard one-year warranty and will be serviced and supported by the Supplier.• The Bidder has delivered 5,000 prepaid water meters and accessories within a period of 10 months.• There will be a Defects Liability Period of 12 months from the date of installing prepaid water meters and accessories. The Bidder must commit themselves to replace all the prepaid water meters and accessories that become faulty during the defects liability period• The software for operating and managing the prepaid water meters should be updated if and when necessary. The Bidder must commit themselves to update the software at no extra cost to the Purchaser• The Bidder has well-qualified and experienced personnel to train the Purchaser’s staff members in the installation and management of the prepaid water meters and accessories including the software.(d) Price evaluation: Quoted prices shall be evaluated and adjusted to take into account arithmetic errors as well as discounts, where applicable.

17.Award criteriaResponsive bid to requirements specified in the bidding document, price and adherence to specifications (or, if appropriate after derogation, the best value for money which is a combination of quality and price).

18.How to obtain the tender dossierThe tender dossier can be obtained from the Contracting Authority. 22.Additional informationa. A complete set of Bidding Documents in English may be purchased by interested bidders upon payment of a non-refundable fee of MK15,000 or US$20. The method of payment will be cash or Bank certified cheque at the Northern Region Water Board cash office. The Bidding Documents will be collected by the interested bidder.b) Bidding will be conducted through the International Competitive Bidding (ICB) procedures specified in the European Investment Bank’s Guide to Procurement for Projects Financed by EIB (2011). Bidding is open to all bidders from Eligible Source Countries as defined in the Bidding Documents.c) All bids must be written in English. If some parts of the bid are submitted in any other language, the bidder must provide translation in English.
